The "App/Service" means Wildfire Info, including the mobile application and data services.
The "End User" means a person who ultimately uses or is intended to ultimately use the App/Service.
This End-User License Agreement and Terms of Service is concluded between David Gross and the End-User only, and not with Apple. David Gross is solely responsible for the App/Service and the content thereof.
Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App/Service.
A user is granted a non-exclusive, non-transferable, non-sharable, revocable, limited license to use the App/Service solely for personal, non-commercial use in accordance with the terms outlined below. The App/Service may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
In the event of any failure of the App/Service to conform to any applicable warranty, the End-User may notify Apple, and Apple will refund the purchase price for the App/Service to that End-User; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App/Service, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be David Gross' responsibility.
David Gross, and not Apple, is responsible for addressing any claims of the End-User.
David Gross, and not Apple, is responsible for the investigation, defense, settlement, and discharge of any intellectual property infringement claim.
The End-User must represent and warrant that they are not located in a country subject to United States embargo, or that has been designated by the U.S. government as a "terrorist supporting" country, and that he/she is not listed on any U.S. Government list of prohibited or restricted parties.

The End-User must also comply and be aware of "How Google Uses Information From Sites or Apps That Use Our Services"
Apple, and Apple's subsidiaries, are third-party beneficiaries of the EULA. Upon accepting the EULA, Apple will have the right to enforce the EULA against the End-User as a third party beneficiary.
While using the App/Service, you cannot: be unlawful; harass, threaten, abuse, or intimidate other users; impersonate someone else; spam other users; reverse engineer any related software; or develop third-party apps that have an interaction.
If you are in breach of any of these Terms, we reverse the right, in our sole discretion, to terminate your right to access or use the App/Service. We are not responsible for any loss, damage or harm related to your inability to access or use the App/Service based on such termination.
The App/Service, including parts of it, may not be downloaded, copied, reproduced, transmitted, stored, sold, or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying, and/or printing of pages of the App/Service for personal, non-commercial use only.
The App/Service does not claim ownership of any Content you post, upload or submit to any publicly accessible area. However, by doing so you are granting a worldwide, royalty-free, sub-licensable, non-exclusive license to copy, distribute, transmit, reproduce, publicly display, display, edit, translate, or publish such Content on the App/Service. This license shall be terminated when such Content is deleted from the App/Service by the copyright holder.
The App/Service will respond to takedown notices of alleged copyright infringement and remove any content that users post that they do not own the rights to. To submit a notice of such content, contact davidgrossapps@gmail.com
All subscription payments are processed through the Apple App Store.
These Terms can be modified at any time. Users should periodically check the Terms for these changes. After the Terms have been modified, a user will be agreeing to the new Terms if they continue using the App/Service.
The App/Service is provided "as is". There is no warranty provided. Users are using the App/Service at their own risk. The App/Service cannot be guaranteed to be free from mistakes, malware, errors, or other issues that could potentially damage a user.
The App/Service will not be held liable for any damages that arise from the use of this app. This includes no liability for loss of data; conduct of third parties; inability to access the app, copyright infringement of others, any other damages that occur.
If a dispute arises, the Terms are subject to the laws of the United States of America, without regard to choice or conflicts of law principles.
